These Terms of Service (“Terms”) govern access to and use of the Serve Right Solutions platform (the “Service”), operated by Serve Right Solutions (“Serve Right,” “we,” “us,” or “our”). By registering for, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, incorporated by reference. If you do not agree, do not use the Service.
Serve Right is a two-sided marketplace operating in Washington State that connects property management companies and other legal-notice senders (“PM Users”) with independent process servers (“Server Users”) to facilitate the submission, claiming, and fulfillment of process-serving jobs, including document upload, status tracking, and generation of a Declaration of Service.
Serve Right is a technology platform only. We do not perform process serving ourselves, and we are not a party to the underlying legal matter giving rise to any notice or service request. We do not guarantee the legal sufficiency, timeliness, or outcome of any service performed through the platform.
You must be at least 18 years old and capable of forming a binding contract to use the Service. PM Users represent that they are authorized to submit service requests on behalf of the property or entity named. Server Users represent that they meet all applicable Washington State requirements to perform process serving, including any registration required under RCW 18.180, and are solely responsible for maintaining that eligibility throughout their use of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. PM organization accounts may designate one or more organization administrators with elevated permissions (billing, team management); organization administrators are responsible for managing who has access to their organization's account.
4.1 Pricing. Serve Right sets platform pricing for each service type (Standard, Rush, Same Day) and any additional-copy fees, as displayed at the time of job submission. Pricing may be updated from time to time; changes apply prospectively to new job submissions.
4.2 Billing Timing. PM Users are charged at the time a job is submitted, not upon completion. This allows Serve Right to guarantee compensation to Server Users for accepted work and avoids collection risk on completed services.
4.3 Payment Processing. All payments are processed by Stripe, Inc., a third-party payment processor. Serve Right does not store your full payment card or bank account details. Processing fees charged by Stripe are absorbed by Serve Right and are not passed on to PM Users as a separate line item.
4.4 Server Payouts. Server Users are paid a fixed portion of the job price, as displayed at the time of job claim, following successful completion of the service and a standard hold period. Payouts are issued via Stripe Connect to the bank account or debit card the Server User has connected.
5.1 A PM User may cancel a submitted job. If the job is cancelled within 24 hours of submission and has not yet been claimed by a Server User, the PM User will receive a full refund.
5.2 If a job has already been claimed by a Server User at the time of cancellation, refund eligibility will be determined by Serve Right on a case-by-case basis, taking into account factors including but not limited to whether the Server User has already commenced or completed the requested service.
5.3 Refunds, where granted, are currently processed manually by Serve Right and may take a reasonable period of time to appear on the original payment method.
Server Users are independent contractors, not employees, agents, or partners of Serve Right. Server Users determine their own methods, schedule, and manner of performing process-serving services, subject to applicable law and the requirements of the specific job accepted. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between Serve Right and any Server User.
Server Users are solely responsible for complying with all applicable laws governing process serving in Washington State, including but not limited to RCW 59.12.040 and any applicable registration or licensing requirements, and for the accuracy of any Declaration of Service they submit through the platform.
You agree not to: (a) use the Service for any unlawful purpose; (b) submit false, fraudulent, or misleading information, including in a Declaration of Service; (c) attempt to circumvent the platform's payment or matching systems to transact outside the Service; (d) interfere with or disrupt the Service's operation or security; or (e) use the Service to harass, threaten, or harm any individual named in a notice or service request.
The Service, including its software, design, and content (excluding documents uploaded by users), is owned by Serve Right and protected by applicable intellectual property laws. You retain ownership of documents you upload but grant Serve Right a limited license to store, process, and transmit them as necessary to provide the Service.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SERVE RIGHT DOES NOT WARRANT THAT ANY SERVICE PERFORMED THROUGH THE PLATFORM WILL SATISFY THE LEGAL REQUIREMENTS OF ANY PARTICULAR COURT, JURISDICTION, OR PROCEEDING. USERS ARE SOLELY RESPONSIBLE FOR DETERMINING WHETHER SERVICE PERFORMED THROUGH THE PLATFORM MEETS THEIR LEGAL NEEDS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVE RIGHT'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SERVE RIGHT IN THE 12 MONTHS PRECEDING THE CLAIM. SERVE RIGHT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES ARISING FROM A MISSED LEGAL DEADLINE OR IMPROPERLY COMPLETED SERVICE.
You agree to indemnify and hold Serve Right harmless from any claims, damages, or expenses arising from your breach of these Terms, your violation of applicable law, or your use of the Service.
Before either party initiates arbitration or a court proceeding, the party with a dispute must provide written notice describing the dispute and the relief requested. Serve Right Solutions will send notices to the email or mailing address associated with the user's account.
The parties will work in good faith to resolve the dispute informally for at least thirty (30) days after notice is received. This requirement does not prevent either party from seeking emergency or temporary equitable relief where permitted by law.
Except for the matters expressly excluded below, you and Serve Right Solutions agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website or services, or the relationship between you and Serve Right Solutions, including claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved by binding individual arbitration rather than in court.
This agreement to arbitrate is governed by the Federal Arbitration Act and, to the extent applicable, Washington law. The arbitrator, and not a judge or jury, will decide the dispute, except that a court of competent jurisdiction will decide any issue concerning the existence, validity, or enforceability of this arbitration agreement where required by applicable law.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, except as modified by these Terms. Those rules are available at www.adr.org.
Unless the parties agree otherwise, the arbitration will take place in the Washington county where you reside or by video or telephone conference when permitted by the AAA rules. The arbitration will be conducted by one neutral arbitrator. The arbitrator may award any individual relief available under applicable law, but only to the extent necessary to provide relief for the individual claim before the arbitrator.
Fees and costs will be allocated in accordance with the AAA Consumer Arbitration Rules and applicable law. Nothing in these Terms limits either party's right to recover attorneys' fees or costs when such recovery is authorized by applicable law.
Either party may bring an individual claim in small-claims court if the claim qualifies and remains in that court. Either party may also seek temporary, preliminary, or emergency injunctive relief from a court of competent jurisdiction when necessary to prevent imminent harm, preserve the status quo, or protect intellectual-property rights.
Nothing in this section is intended to waive or limit any right, remedy, claim, or forum that cannot lawfully be waived under applicable law. To the extent a claim for public injunctive relief cannot lawfully be required to proceed in arbitration, that claim may proceed in court after any arbitrable individual claims have been resolved.
To the fullest extent permitted by law, you and Serve Right Solutions agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, coordinated, mass, private-attorney-general, or other representative proceeding.
Unless both you and Serve Right Solutions agree in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, or representative proceeding.
If any portion of this Dispute Resolution section is found to be invalid or unenforceable, that portion will be severed and the remainder will remain in effect, except that if the class-action and representative-action waiver is found unenforceable as to a particular claim, that claim must proceed in a court of competent jurisdiction rather than in arbitration.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Serve Right may update these Terms from time to time. Material changes will be communicated to users through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
