Process Server Addendum

1. Relationship to the Terms of Service

This Process Server Addendum (“Addendum”) supplements and is incorporated into the Serve Right Solutions Terms of Service (the “Agreement”) between you (“Server”) and Serve Right Solutions (“Serve Right,” “we,” “us”). It sets out additional terms specific to your provision of process-serving services through the Serve Right platform. Capitalized terms not defined here have the meaning given in the Agreement. Except where expressly modified by this Addendum, all provisions of the Agreement remain in effect.

2. Server Services

The Service allows you to browse available process-serving jobs posted by PM Users, claim jobs you are eligible and available to perform, complete service of the relevant legal documents or notices, and submit a Declaration of Service and any required proof-of-service documentation through the platform. You are solely responsible for determining, before claiming a job, whether you are able to complete it in accordance with the deadline and requirements specified.

3. Server Accounts and Eligibility

To provide Server Services, you must register for and maintain an active Server account. You must be at least 18 years old. Account registration requires accurate name, address, phone number, service area/county coverage, and payment/payout information. You are solely responsible for maintaining accurate, current account information, including a valid connected payout account — Serve Right cannot issue payment without one. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. You agree to comply with all applicable laws, including any Washington State registration or eligibility requirements applicable to process servers, in connection with your use of the Service.

4. PM User Responsibilities

PM Users are solely responsible for: (a) the accuracy and completeness of documents and information they submit for a job, including the correct service address and recipient information; (b) having a lawful basis for the notice or legal document being served; and (c) providing any special instructions reasonably necessary for you to safely and correctly complete service. Serve Right expressly disclaims liability arising from a PM User's failure to meet these responsibilities, including inaccurate addresses or documents provided at job submission.

5. Payment to Servers

5.1 Compensation. You will receive a fixed payout amount for each completed job, as displayed to you at the time you claim the job. Serve Right reserves the right to set and adjust payout amounts for future jobs at its discretion; adjustments do not apply retroactively to jobs already claimed.

5.2 Payment Timing and Method. Payouts are issued via Stripe Connect to the bank account or debit card you have connected, following successful completion of the job (including submission of a valid Declaration of Service) and a standard hold period. You are solely responsible for maintaining a valid, active connected payout account; Serve Right is not responsible for delayed or failed payouts resulting from an invalid or disconnected account.

5.3 Cancelled Jobs. If a PM User cancels a job after you have claimed it, your compensation depends on whether service was already completed. If you have already completed service (including submission of a valid Declaration of Service) at the time of cancellation, you will be paid the full compensation for that job as usual. If the job is cancelled before service has been completed, no compensation is payable for that job.

5.4 Taxes. Payouts are exclusive of any applicable taxes. You are solely responsible for reporting and remitting any taxes owed on amounts paid to you.

6. Independent Contractor Relationship

You are retained by Serve Right solely for the purposes set out in the Agreement and this Addendum, and your relationship to Serve Right is that of an independent contractor. You control the manner and means by which you perform process-serving services, subject to applicable law and the specific requirements of each job you accept. Serve Right does not direct or control the methods by which you perform your work, except as expressly set out in the Agreement. Nothing in the Agreement or this Addendum shall be construed as creating an employment, partnership, joint venture, or agency relationship between you and Serve Right. You are free to accept or decline any job, and to provide similar services to other platforms or clients.

7. Compliance with Applicable Law; Indemnification

Serve Right is a technology platform and is not itself a licensed process-serving agency, law firm, or provider of legal services. You are solely responsible for complying with all applicable laws governing process serving in Washington State, including but not limited to RCW 59.12.040 and any applicable registration requirements, and for the truthfulness and accuracy of any Declaration of Service you submit. You agree to indemnify and hold Serve Right harmless from any claims, damages, or expenses arising from your breach of this Addendum, your violation of applicable law, the manner in which you performed a service, or any dispute between you and a third party relating to your provision of Server Services.

8. Suspension and Termination

Serve Right may suspend or terminate your Server account for violations of the Agreement or this Addendum, failure to maintain required eligibility, a pattern of failed or incomplete service attempts, or as otherwise described in the Agreement.
